En fevrier 2026, une graphiste independante specialisee en image de marque a remis a une startup tech une identite visuelle complete : logo, systeme de couleurs, typographie et charte graphique. Sa facture s'elevait a CHF 8'400. Le client a paye 50 pour cent, puis plus rien. Quatre mois plus tard, la startup a lance son produit avec l'identite complete, en attribuant la creation a une autre designer. La position du client : il avait paye pour le travail, donc il en etait proprietaire. La graphiste n'avait pas de contrat signe avec une clause PI explicite. Elle n'avait pas de preuve de livraison horodatee. Elle avait des captures d'ecran et une facture.

Ce n'est pas un cas isole. Sans accord ecrit qui regle explicitement le droit d'auteur, la question de la propriete d'une oeuvre livree varie selon la juridiction et se tranche souvent en faveur de celui qui dispose des meilleures preuves. En Suisse et dans l'UE, le travail d'un contractant independant reste la propriete du createur en l'absence de clause de cession explicite. Mais prouver que vous avez cree l'oeuvre et quand exige une documentation que la plupart des creatifs ne conservent pas. La liste de controle ci-dessous comble ces lacunes. Rien ici ne requiert de competences juridiques ni de frais importants en amont.
