Il portafoglio europeo di identità digitale (EUDIW), reso obbligatorio da eIDAS 2.0 per tutti gli Stati membri dell'UE entro dicembre 2026, rende le firme e le marche temporali elettroniche qualificate pienamente mobili. Combinato con una marca temporale qualificata di un QTSP della lista di fiducia dell'UE, l'EUDIW consente una protezione della PI valida in tribunale direttamente dal telefono — e le imprese svizzere accedono allo stesso quadro grazie al riconoscimento bilaterale previsto dalla ZertES.
Nell'ottobre 2024, uno studio di design UX e motion con sede a Vienna aveva consegnato un'interfaccia prodotto completa a una startup fintech in base a una lettera d'intenti, in attesa della firma del contratto. Tre settimane dopo la consegna, il direttore creativo di nuova nomina della startup aveva presentato un portfolio che includeva i wireframe e il sistema di animazione dello studio, rivendicandone la paternita. Lo studio disponeva di file di versioni interne, la startup aveva i deliverable e un avvocato. Senza un timestamp qualificato su un singolo file di design, lo studio non poteva stabilire una data di creazione con presunzione legale.
Il portafoglio europeo di identita digitale (EUDIW) e il fulcro dell'aggiornamento eIDAS 2.0, formalmente adottato dal Parlamento europeo nel marzo 2024 come Regolamento (UE) 2024/1183 che modifica il Regolamento eIDAS 910/2014. Ogni Stato membro dell'UE deve fornire ai propri cittadini almeno un EUDIW certificato entro dicembre 2026.
