En septembre 2024, une startup zurichoise a engage un developpeur independant pour concevoir un moteur de recommandation pour sa plateforme SaaS B2B. Le developpeur a livre l'algorithme en decembre et facture CHF 42 000. Deux mois plus tard, le CTO nouvellement recrute de la startup a affirme que l'algorithme etait derive de recherches internes anterieures au contrat. L'equipe juridique de la startup a exige une preuve de creation independante. Le prestataire disposait d'un depot Git. Les avocats de la startup avaient une seule question : qui peut confirmer l'authenticite des horodatages de commits ?

Git est un outil de collaboration, pas un systeme d'archivage juridique. L'historique est modifiable par conception : git commit --amend modifie l'horodatage d'un commit, git push --force recrit une branche entiere. Sans meme fraude deliberee, les horodatages Git peuvent etre contestes. Dans un litige portant sur la paternite d'un algorithme proprietaire, l'historique Git est un point de depart, non une conclusion.
