الطابع الزمني المؤهَّل كدليل في المحكمة: دليل قانوني للاتحاد الأوروبي بموجب المادة 41 من eIDAS (2026)

في سبتمبر 2024، استُدعيت شركة ائتمانية (Treuhand) مقرها فرانكفورت بوصفها حارسة محايدة للوثائق في نزاع تجاري. كان موكلها، وهو مجموعة تصنيعية متوسطة الحجم، بحاجة إلى إثبات تاريخ اتفاقية توريد موقّعة زعمت الطرف المقابل أنها مسبقة التاريخ. كانت الشركة قد حفظت نسخة PDF على خادم المستندات الخاص بها. بيانات تعريف الخادم قابلة للتعديل. ولا تحظى طوابع الوقت في البريد الإلكتروني بأي دعم من مزودي خدمات الثقة المؤهلين. دون طابع زمني إلكتروني مؤهل وفق المادة 41 من eIDAS، كانت لدى الشركة أدلة وثائقية لكن لا قرينة قانونية، وظلّ عبء الإثبات على عاتق الموكل طوال 18 شهراً من التحكيم.

نعم. بموجب المادة 41 من لائحة eIDAS، يتمتع الطابع الزمني الإلكتروني المؤهل بقرينة قانونية على دقة التاريخ والوقت المشار إليهما وسلامة البيانات المرتبطة به. هذه القرينة واجبة النفاذ في جميع دول الاتحاد الأوروبي السبع والعشرين دون الحاجة إلى إثبات إضافي، مما يحوّل عبء الطعن إلى الطرف الخصم.
