في مارس 2025، سلّمت وكالة تجربة مستخدم مقرها بازل هوية علامة تجارية كاملة لشركة ناشئة في مرحلة السلسلة الأولى، قبل ثلاثة أيام من توقيع عقد العميل المضاد. وبعد أسبوعين من التسليم، ادّعى المصمم الداخلي الجديد للشركة الناشئة ملكية النظام البصري بأكمله. كانت الوكالة قد استخدمت أدوات الذكاء الاصطناعي طوال فترة المشروع: إذ كان كل مدخل موجّهاً، وكل مخرج مراجعاً، وكل قرار متعلق بالخطوط مدروساً. غير أنه لم يكن ثمة طابع زمني مؤهّل على أي مسودة أو ملخص مشروع أو ملف تكرار. سأل محامو الشركة الناشئة المستشار القانوني للوكالة سؤالاً واحداً فقط: أثبتوا أن الوكالة هي من أنشأه أولاً. ولم تكن لدى الوكالة أي إجابة تصمد أمام المحكمة.

لم تتوقف نتيجة هذا النزاع على من قام بالعمل فعلياً، بل على من وثّق العملية الإبداعية في وقت حدوثها. يتكلف قضية انتهاك الملكية الفكرية المتوسطة في الاتحاد الأوروبي ما بين 250,000 يورو و1.2 مليون يورو (المكتب الأوروبي للملكية الفكرية، 2023). كان يمكن ختم موجز الوكالة والمسودة الأولى وثلاث جولات مراجعة، كل منها بـ 5 فرنكات سويسرية للوثيقة. أربعة أختام بمجموع 20 فرنكاً سويسرياً، في مقابل تعرض قانوني بستة أرقام.
