मार्च 2025 में, बासेल स्थित एक UX एजेंसी ने एक Series A स्टार्टअप को क्लाइंट का अनुबंध काउंटरसाइन होने से तीन दिन पहले एक पूर्ण ब्रांड पहचान सौंपी। हैंडओवर के दो हफ्ते बाद, स्टार्टअप के नए इन-हाउस डिजाइनर ने पूरे विजुअल सिस्टम की लेखकता का दावा कर दिया। एजेंसी ने पूरे प्रोजेक्ट में AI टूल्स का इस्तेमाल किया था: हर प्रॉम्प्ट निर्देशित था, हर आउटपुट संशोधित था, हर टाइपफेस निर्णय जानबूझकर लिया गया था। लेकिन किसी भी ड्राफ्ट, ब्रीफ या इटरेशन फाइल पर कोई योग्य टाइमस्टैम्प मौजूद नहीं था। स्टार्टअप के वकीलों ने एजेंसी के कानूनी सलाहकार से एक ही सवाल पूछा: साबित करें कि एजेंसी ने इसे पहले बनाया। एजेंसी के पास कोई ऐसा जवाब नहीं था जो अदालत में टिक सके।

उस विवाद का परिणाम इस पर निर्भर नहीं था कि वास्तव में काम किसने किया, बल्कि इस पर कि किसने रचनात्मक प्रक्रिया को उस समय दस्तावेज किया जब वह हो रही थी। यूरोपीय संघ में एक औसत IP उल्लंघन मामले में EUR 250,000 से EUR 1.2 मिलियन का खर्च आता है (EUIPO, 2023)। एजेंसी का ब्रीफ, पहला ड्राफ्ट और तीन संशोधन दौर प्रत्येक CHF 5 प्रति दस्तावेज पर सील किए जा सकते थे। कुल CHF 20 में चार सील, छह अंकों के कानूनी जोखिम के मुकाबले।
