La Cartera Europea de Identidad Digital (EUDIW), exigida por eIDAS 2.0 a todos los Estados miembros de la UE antes de diciembre de 2026, hace que las firmas y sellos de tiempo electrónicos cualificados sean totalmente móviles. Combinada con un sello de tiempo cualificado de un QTSP de la lista de confianza de la UE, la EUDIW permite una protección de la PI admisible ante los tribunales desde su teléfono, y las empresas suizas acceden al mismo marco mediante el reconocimiento bilateral previsto en la ZertES.
En octubre de 2024, un estudio de diseno UX y motion con sede en Viena entrego una interfaz de producto completa a una startup fintech en virtud de una carta de intencion, pendiente de la firma del contrato. Tres semanas despues de la entrega, el director creativo recien contratado por la startup presento una candidatura de portfolio que incluia los wireframes y el sistema de animacion del estudio, reclamando la autoria. El estudio tenia archivos de versiones internas, la startup tenia los entregables y un abogado. Sin una marca de tiempo cualificada en un solo archivo de diseno, el estudio no podia establecer una fecha de creacion con presuncion legal.
La Cartera Europea de Identidad Digital (EUDIW) es la pieza central de la actualizacion eIDAS 2.0, adoptada formalmente por el Parlamento Europeo en marzo de 2024 como Reglamento (UE) 2024/1183 que modifica el Reglamento eIDAS 910/2014. Cada Estado miembro de la UE debe proporcionar al menos una EUDIW certificada a sus ciudadanos antes de diciembre de 2026.
