En avril 2025, une agence creative basee a Lugano a livre une identite de marque complete a une startup zurichoise en serie A. Le contrat n'avait pas encore ete contresigne. Trois semaines apres la livraison, le nouveau directeur creatif interne de la startup a revendique le logo, le systeme typographique et les directives de motion comme son propre travail. L'agence n'avait aucun horodatage qualifie sur aucun livrable. Son avocat a pose la question qui ouvre chaque litige en matiere de propriete intellectuelle: pouvez-vous prouver que vous avez cree cela en premier?

En Suisse, la Loi federale sur le droit d'auteur (LDA) garantit la protection des oeuvres litteraires, artistiques, musicales et logicielles des le moment de la creation, sans qu'aucun enregistrement soit requis. Ce principe est egalement consacre par la Convention de Berne (181 Etats membres), dont la Suisse fait partie: vos droits naissent avec l'acte creatif. Dans la pratique, cette protection automatique ne suffit pas. La loi reconnait votre droit, mais elle ne cree pas elle-meme la preuve du moment de creation, de la forme exacte de l'oeuvre, ni de votre identite en tant qu'auteur.
