A principios de 2024, una empresa fiduciaria zurichense presento una oferta para un proyecto de infraestructura publica por encima del umbral federal de CHF 230.000 en contratacion publica. La oferta ganadora se apoyaba en una serie de declaraciones firmadas, todas producidas como PDF estandar sin sellos cualificados. Cuando un competidor impugno la integridad de los documentos seis meses despues, la oficina cantonal de contratacion publica solicito una prueba criptografica de que las declaraciones no habian sido alteradas tras su presentacion. La empresa no tenia ninguna. La impugnacion desencadeno un proceso de reevaluacion que costo a la empresa el contrato y CHF 180.000 en gastos administrativos y legales. Bajo ZertES SR 943.03, un sello cualificado de un proveedor acreditado por BAKOM habria cerrado esa puerta de inmediato.
Ese resultado es exactamente lo que previene el cumplimiento de ZertES. Para las empresas suizas en contratacion publica, servicios financieros, sanidad y actividades proximas al litigio, el marco ya no es una formalidad legal. Es la base para documentos juridicamente defendibles.
